Packaging and Labeling Requirements

In order to maintain compliance with the Oklahoma Medical Marijuana and Patient Protection Act (OMMPPA), 63 O.S., § 427.1 et seq., and Oklahoma Administrative Code (OAC) 310:681. business licensees shall not distribute, sell, or transfer medical marijuana and medical marijuana products inappropriately packaged or labeled. The OMMPPA or OAC 310:681 require dispensaries to return or refuse to accept any marijuana or cannabis products which are not labeled and packaged in accordance with the OMMPPA or OAC 310:681. 

• Toys, cartoon characters, and similar images on labels, packages, and containers shall not be appealing to minors. Package design should limit children's attraction to the medical marijuana product, and should only depict the producer's business logo, name, and product image. 
• False or misleading statements are not permitted on packages or labels. 
• It shall not be the intended, the packaging or labeling of the medical marijuana products that causes a patient uncertainty as to whether the products are trademarked. 
• The packaging or labeling of any medical marijuana or medical marijuana product shall not violate national trademark laws. 
• Labels and packaging may not falsely state that its products provide benefits to patients in terms of physical health or well-being.

Required Information

• Potency of THC
• Potency of Terpenoid
• Labeling with government warning should include the following: 
• – “THIS PRODUCT HAS BEEN TESTED FOR CONTAMINANTS.” 
• – “WOMEN SHOULD NOT USE MARIJUANA OR MEDICAL MARIJUANA PRODUCTS DURING PREGNANCY BECAUSE OF THE RISK OF BIRTH DEFECTS.” 
• – “KEEP OUT OF REACH OF CHILDREN.” 
• The Oklahoma Uniform Symbol (or universal symbol) must be displayed clearly and in plain sight on all packages and individually packaged product units, including bulk packed products. An ideal size for the universal symbol is 1/2 inch by 1/2 inch (.06" x .085"), and it should be red with black text as shown below.

Child-resistant Packaging

A child-resistant container must be used at the point of sale for the packaging of medical marijuana and medical marijuana products. Packaging that is child-resistant: 

• 16 CFR 1700.15 (1995) and 16 CFR 1700.20 (1995) require that a child (5) years of age or under,  cannot open and that adults shouldn't have any difficulty using it properly. 
• Outer packaging materials should be opaque, so that the product is not visible without opening.
• Any product intended for more than one use or containing multiple servings should be able to be resealed to maintain its child-resistant effectiveness. 

Recommendations

• Informative displays should be legible and clear. 
• The font should be at least 6-points and in English. 
• The outer layer of packaging should include all required labeling. 
• When a package is too small to include all the required information on the outside, an information panel may be used.
